(GODERICH, ON) – A Goderich man is facing criminal charges, following a traffic stop in the Town of Goderich April 13.
At approximately 9:40 p.m., a Huron County OPP officer spotted an E-bike driver operating his vehicle without a helmet and without lights. The driver was subsequently stopped at the intersection of Newgate Street and Victoria Street North.
While speaking with the man, police noted he had consumed some alcohol and was displaying several signs that his ability to operate was impaired. The driver was arrested for Impaired Operation and was transported to the Huron OPP detachment for breath tests. He provided two samples of his breath to a qualified Intoxilizer Technician and both tests registered over the legal limit.
As a result, 48-year-old Dean MURRAY of Goderich has been charged with Impaired Operation and Drive Motor Vehicle – Over-80 Milligrams of Alcohol. He was later released from custody with a court appearance scheduled for June 6, at the Ontario Court of Justice – Goderich. He also received an automatic 90-day driver’s licence suspension and his E-bike has been impounded for seven days.
Note: E-bike drivers are reminded, drinking and driving a motor vehicle is a Criminal Code offence and charges are laid under the Criminal Code of Canada. Under the Criminal Code, the definition of a "motor vehicle" includes an E-bike, and anyone operating an E-bike while impaired by alcohol or drugs, can be charged for impaired driving. If convicted, Criminal Code penalties include fines or jail time, and a driving prohibition.
E-bike operators must also be 16 years of age and must wear an approved bicycle or motorcycle helmet.
